Terms and Conditions

Article 1. Applicability

1.1 These general terms and conditions apply to all written and oral offers and agreements under which Elena offers or delivers her work. Deviations from these conditions are only valid if agreed in advance in writing.

1.2 These general terms and conditions also apply to additional assignments and follow-up assignments from the client.

1.3 Any other general terms and conditions of the client do not apply unless they have been accepted in writing in advance by Elena.

Article 2. Registrations

2.1 A registration for a client or participant is only final after payment and receipt of confirmation. If there is a maximum number of participants for a training, coaching or workshop, registration will take place based on receipt of registrations.

2.2 Elena is free to change the location of a training, coaching or workshop.

2.3 The client or participant must inform Elena at all times before participating if the client or participant:

• is pregnant,
• is taking medication,
• has a physical or psychological illness or disability,
• is under treatment by a doctor or therapist

This enables Elena to tailor the offer accordingly, to request approval from a doctor in consultation with the participant, to advise the client/participant or and/or to refuse the client/participant.

2.4 By registering you agree to the general terms and conditions.

Article 3. Deregistration or cancellation by client or participant

3.1 The client or participant has the right to cancel the registration for an activity by e-mail or letter. Cancellation only applies if the client or participant has received confirmation from Elena of receipt of the cancellation. In case of cancellation by letter, the calculation will be made from the date of the postmark. For cancellation after registration, the following costs will be charged to the client or participant:

• If you cancel within 14 days, no costs will be charged and the participant will receive a full refund.
• If canceled more than 60 days before the start date, 15% of the price will be charged, unless canceled within 14 days of registration.
• If canceled within 30 days before the start date, 60% of the price will be charged, unless cancellation is made within 14 days of registration.

Article 4. Cancellation or rescheduling by Elena

4.1 Elena is entitled to cancel a training, coaching or workshop without giving reasons. In that case, the client or participant is entitled to a refund of the full amount paid to Elena, or a proportion thereof.

4.2 Elena is entitled to refuse or suspend the participation of the client or participant without giving any reason if the client has not met the payment obligations on time.

4.3 Elena is entitled to change the date of a coaching, training or workshop. The client or participant will be informed of this in writing or by e-mail.

4.4 Elena is entitled to change the location of a coaching, training or workshop, or to offer it online. The client or participant will be informed of this in writing or by e-mail.



4.5 Elena is entitled to appoint a different teacher, trainer or teacher than communicated in advance. Elena tries to appoint someone with sufficient knowledge of what is offered.

4.6 Elena is allowed to cancel or suspend a training, coaching or workshop if there are not enough registrations (Elena determines a lower limit for each offer).

4.7 Elena is free to cancel already confirmed registrations or refuse a participant. In these cases, the participant is entitled to a refund of the amount paid to Elena relating to this service in question, or a proportion thereof.

Article 5. Quotations

5.1 The quotations made by Elena are without obligation; they are valid for 30 days, unless otherwise stated. Elena is only bound to the quotations if their acceptance is confirmed in writing by the other party.

Article 6. Payment

6.1 Payment is always made in advance or on the day before work commences and if otherwise agreed and no payment is made in advance, payment must be made within 14 days of the invoice date. Payment will be made without deduction, set-off or suspension on any grounds whatsoever.

6.2 If the client has not paid the amounts due no later than the due date, he will automatically be in default, without further notice of default being required. In the event of payment default by the client, Elena is entitled to immediately cease or suspend all work to be performed for the client, without being liable to pay damages to the client in any way.

6.3 In the event of payment default, the client is furthermore liable to pay default interest on the outstanding claims equal to the statutory interest.

 

6.4 In the event of liquidation, bankruptcy or suspension of payment of the client, Elena's claims and the client's obligations towards Elena will be immediately due and payable.

Article 7. Collection costs

7.1 In the event that Elena, for reasons of her own, decides to collect a claim for non-payment of one or more unpaid invoices through legal means, the client is, in addition to the principal sum and interest due, also obliged to reimburse all reasonably incurred judicial and extrajudicial costs. . This will always include the costs of collection agencies, as well as the costs and fees of bailiffs and lawyers, even if these exceed the legal costs to be awarded in court.

Article 8. Personal data

8.1 By entering into an agreement with Elena, Elena is given permission for automatic processing of the personal data obtained from the agreement. Elena will only use these personal data for her own work. See the privacy page for more information.

Article 9. Complaints

9.1 Complaints must be reported to Elena with a detailed description by e-mail or in writing within 10 working days. Elena tries to respond adequately and, if a complaint is justified, to remedy it.

9.2 Complaints submitted will be answered within a reasonable period of 10 days from the date of receipt.

 

9.3 If the complaint cannot be resolved by mutual agreement, a dispute arises that is subject to the dispute settlement procedure.

9.4 Dutch law applies to every agreement between Elena and the client.

9.5 Disputes arising from agreements to which these conditions apply and which do not fall within the jurisdiction of the subdistrict court, will be submitted to the competent court of the district in which Elena is located.

9.6 Submitting a complaint does not release the client or participant from the payment obligation.

Article 10. Liability

10.1 Elena accepts no liability whatsoever for damage caused by or in connection with work performed by her.

10.2 Elena's liability is limited to the invoice value of the assignment, only that part of the assignment to which the liability relates.

10.3 If damage is caused to persons or property by or in connection with the provision of services by Elena, for which Elena is liable, that liability will be limited to the amount of the payment under the general liability insurance taken out by Elena, including the deductible that Elena bears in connection with that insurance.

10.4 Any liability of Elena for business damage or other indirect or consequential damage of any nature is expressly excluded.

Article 11. Retention of title and Copyright

11.1 All media and information provided and sent are protected by copyright and may not be copied, reproduced or otherwise multiplied or made public.

11.2 Making video recordings of a coaching, training, workshop or other service offered (or part thereof) is not permitted for participants and clients.

Article 12. Video

12.1 Elena has the right to make recordings during coaching, training and retreats. These recordings can be put online or shared at a later time. Participants will be informed of this in advance.

Article 13. Confidentiality and non-disclosure agreement

13.1 Both Elena and the client or participant are obliged to treat all non-publicly available information from and about Elena, information from and about the client or participant, as well as information from and about other participants confidentially and will not disclose this information to third parties. unless written permission has been given by the party from which the information originates.

Article 14. Other provisions

14.1 Elena has the right to adjust the prices or content of coaching, training and workshops.

14.2 If the client or participant causes such an inconvenience or nuisance before or during a coaching, training or retreat that, according to the trainer/therapist, proper execution is hampered, Elena has the right to refuse or remove this person for the event in question and to refuse subsequent coaching, training, workshops, retreats or any other offer. The client or participant will not receive the money paid back.
